Nationwide: Today, May 1st, 2026 the Federal 5th Circuit Court granted the State of Louisiana’s challenge to the FDA’s 2023 rule that allowed for mifepristone, the primary medication abortion pill, to be dispensed via telehealth. While further litigation continues, abortion providers will no longer be permitted to dispense mifepristone to patients without an in-person visit, despite the safety and efficacy of telehealth medication abortion care.

Missourians are not currently able to access medication abortion via telehealth from other states, however, the State of Missouri is also currently challenging the FDA over the safety of abortion pills in another federal case. Abortion clinics in Missouri also cannot currently provide medication abortion pills because of unconstitutional and medically unnecessary restrictions put in place by politicians that are being challenged in court.

Statement from Abortion Action Missouri Executive Director Mallory Schwarz,

“Once again we see courts acting on a political agenda and advancing dangerous propaganda rather than relying on science, medicine, or the law. The Louisiana v FDA case is part of a targeted national strategy that has Missouri’s Senator Josh Hawley at the forefront. Anti-abortion politicians like Hawley, Gov Kehoe, and their cronies always try to mask their attacks on abortion care as concern for “health and safety,” but it’s bans on abortion that put our health and safety at risk. Abortion pills are safe, full stop. And political interference between families, their doctors, and medical experts makes everyone less safe.

Missourians have a constitutional right to access abortion because that’s what Missourians just voted for. No court, no politician, no lawyer, should be able to block your access to health care for their own political agenda. We already said no to abortion bans once, and later this year we will do it again when we vote NO on their new abortion ban Amendment 3.”
